2 Collection and storage of personal data, as well as the nature and purpose of its use

2.1 When visiting the website

When you visit our Website www.dkn-networks.com Information is automatically sent to our website’s server by the browser used on your device. This information is temporarily stored in a log file. The following information is collected without your intervention and stored until it is automatically deleted:

IP address of the requesting computer,

date and time of access,

name and URL of the file accessed,

website from which access is made (referrer URL),

2.2 When registering for our newsletters

We use your email address to send you our newsletter on a regular basis. To receive the newsletter, you only need to provide an email address.

Our newsletters and marketing information contain tracking pixels for statistical analysis. These are necessary to optimize the content of the newsletters and better tailor them to user needs. By integrating the tracking pixel, we can see when an email has been opened by a data subject and which links in the email have been clicked on by the data subject. The data is not passed on to third parties for their purposes.

The use of a service provider to relieve us of this task is a legitimate purpose within the meaning of this provision.

2.3 When using our contact form

If you have any questions, you can contact us using the form provided on the website. You will need to provide your company name, first and last name, subject, and a valid email address so that we know who the inquiry is from and can respond to it. Additional information is optional.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) (a) GDPR on the basis of your voluntary consent. If the purpose of the email contact is to conclude a contract, the additional legal basis for processing is Art. 6 (1) (b) GDPR.

The personal data collected by us for the use of the contact form will be automatically deleted after your request has been processed.

3 Data transfer

Your personal data will not be transferred to third parties for purposes other than those listed below.

We will only disclose your personal data to third parties if:

You have given your express consent to this in accordance with Art. 6 (1) (a) GDPR, the transfer is necessary in accordance with Art. 6 (1) (f) GDPR for the assertion, exercise, or defense of legal claims, and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data, in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and this is legally permissible and necessary for the execution of contractual relationships with you pursuant to Art. 6 para. 1 sentence 1 lit. b GDPR.

If data is transferred to Google through the use of Google Analytics, Google Web Fonts, and Google Maps, the data is generally processed by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, and thus outside the EU. The EU-US Data Privacy Framework (DPF) provides a legal basis for the transfer of data to the USA, which is equivalent to an adequacy decision by the EU Commission. According to this, Google LLC. is obliged to create a level of data protection for the processing of personal data that is comparable to that within the EU.

In order to execute and process the contract, we may pass on your data to external service providers and subcontractors if this is necessary to provide our services to you in accordance with the contract. The legal basis for this is Article 6 (1) (b) GDPR. The data passed on may only be used by third parties for the purposes specified.

We commission an external provider based within the EU to store our data. Your data is transferred to an external service provider for the purpose of coordinated work and the efficient design of our work processes, as well as for data backup purposes. The legal basis for this is Art. 6 (1) lit. f) GDPR. The efficient organization of work processes is to be regarded as a legitimate interest within the meaning of this provision. 

We commission external IT service providers to maintain our IT systems. The legal basis for this is Art. 6 (1) (f) GDPR. The professional maintenance of our IT systems and the processing of customer data are to be regarded as a legitimate interest within the meaning of this provision.

We have also commissioned an external mailing service provider based within the EU to send emails. The legal basis for this is Art. 6 (1) (f) GDPR. The professional and smooth sending of emails is to be regarded as a legitimate interest within the meaning of this provision.

4 Cookies

We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our website. Cookies do not cause any damage to your device and do not contain viruses, Trojans, or other malware.

5.1.3 Google Adwords Conversion Tracking

We also use Google Conversion Tracking to collect statistics on the use of our website and to evaluate it for the purpose of optimizing our website for you. Google Adwords places a cookie (see section 4) on your computer if you have accessed our website via a Google ad.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages of the AdWords customer’s website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Each AdWords customer receives a different cookie. Cookies cannot therefore be tracked across the websites of AdWords customers. 6 Social Media Plug-Ins

5.1 We operate a so-called company page on the social networks LinkedIn and Xing. On this company page, the services provided by LinkedIn and XING enable us to collect and evaluate certain data about visitors to our company page. This data includes [breakdowns by age group, gender, educational level, occupation], provided that visitors to the company page have entered this information in their LinkedIn or XING profile.

5.2 LinkedIn and XING are jointly responsible for processing the data. The legal basis for processing by me is Art. 6 (1) lit. b) GDPR, as we operate the LinkedIn and Xing company pages for the purpose of acquisition and contract initiation. Insofar as the LinkedIn and XING company pages are not used for contract initiation, the legal basis is Art. 6 (1) (f) GDPR. In this case, the purpose of use is the needs-based design and ongoing optimization of our offering, as well as communication with our customers and interested parties. A further purpose is the external presentation, marketing, and promotion of our services and offerings. Our legitimate interest follows from the purposes of data collection.

7 Processing for advertising purposes

We also collect your data from public sources, such as the social networks Xing or LinkedIn, or from websites accessible on the Internet, in order to write to you or call you using the contact details stored there. In doing so, we would like to familiarize you with our offerings and inform you about our services. 

The legal basis for this is Art. 6 (1) (f) GDPR. The submission of offers and the advertising of own or third-party services is a legitimate purpose within the meaning of this provision regulation. 

For this purpose, we only process the personal data that you have publicly posted in the above-mentioned sources. This includes, among other things, your first name, last name, email address, and phone number.  and last name, address, email address, and, if applicable, telephone number, as well as employer and position, if applicable.

We store your data until the above-mentioned purpose has been fulfilled. If you object to the processing for the above-mentioned purposes or request deletion, we will delete the data immediately. However, we reserve the right to store the data necessary to provide evidence that we have complied with your request for deletion or your request for information. As a rule, this is the regular limitation period of 3 years. 

There is no automated decision-making. 

8 Contract conclusion

When you engage us to work for you or use our services, we collect the following information:

  • Information necessary for successful consultation and execution of the contract.

This data is collected

  • to identify you as our customer;
  • in order to provide our services;
  • for correspondence with you;
  • for invoicing purposes;
  • to settle any liability claims that may arise and to assert any claims against you;

Data processing is carried out at your request and is necessary for the purposes stated in accordance with Art. 6 (1) (b) GDPR for the appropriate processing of your order and for the mutual fulfillment of obligations arising from the contract.

The personal data collected by us for the purpose of executing the contract will be stored until the expiry of the statutory retention period.  or possible contractual warranty and guarantee rights are stored and then deleted, unless we are obliged to store them for a longer period in accordance with Article 6 (1) (c) GDPR due to tax and commercial law retention and documentation obligations (from the German Commercial Code (HGB), Criminal Code (StGB) or Fiscal Code (AO)) or you have consented to further storage in accordance with Art. 6 (1) (a) GDPR.

9 Rights of data subjects

You have the right:

pursuant to Art. 15 GDPR to request information about your personal data processed by us. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing, or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making, including profiling and, where applicable, meaningful information about its details;

pursuant to Art. 16 GDPR, to request the immediate correction of inaccurate or incomplete personal data stored by us;

pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, unless processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defense of legal claims;

pursuant to Art. 18 GDPR, to request the restriction of the processing of your personal data if you dispute the accuracy of the data, the processing is unlawful but you oppose its erasure and we no longer need the data, but you need it for the establishment, exercise, or defense of legal claims, or you have objected to the processing pursuant to Art. 21 GDPR;

pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request its transfer to another controller;

pursuant to Art. 7 (3) GDPR, to revoke your consent at any time. As a result, we will no longer be permitted to continue processing data based on this consent in the future, and

to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) (f) GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct marketing. 11 Data security

When you visit our website, we use the widely used SSL (Secure Socket Layer) protocol in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is being transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.
